Procedure for Placing Claims with KMK

Placement:

To place a claim for collection with Kohner, Mann & Kailas, S.C., all you need do is to send us a statement of account, setting forth the name and address of the debtor, telephone number of debtor, the amount owed, and any other available related information, along with a short note or letter advising us to proceed with collection activity.

Additional Available Information:

You should also submit to us copies any related information in your file which may be of help. This type of documentation would include: promissory note or notes, credit application, financial statements, Dun & Bradstreet reports, letters or correspondence from the debtor admitting the indebtedness or arranging payment, and any similar type of data or documentation relating to the debtor admitting to the indebtedness and financial responsibility and assets.

Acknowledgment:

Your claim will be acknowledged by our offices on the same date that it is received, to confirm that we in fact did receive the claim. We will be hard at work the same day it is received, attempting to get you your money and evaluating the situation.

Evaluation and Recommendations:

Shortly after receipt of the matter, our attorneys will fully evaluate the situation and the collection possibilities and will make a full report to you setting forth the facts and conclusions of our investigation. We make clear and concise recommendations as to how the matter should be handled, the advisability of legal action, and discuss all other material considerations. You will be kept abreast of developments by informative periodic reports. Suit will be recommended only if we are of the considered belief that it has a reasonable opportunity for success, and with your prior authorization.

Settlement:

No settlement will be accepted unless and until its advisability is fully considered by you and you understand the rationale for the settlement proposal and approve its acceptance.

Legal Action:

No legal action will be recommended, unless we believe there is a strong prospect for success. No legal action will be commenced until such time as our recommendations are made known to you and you have approved resort to court. These will inform you of our conception of the commitment which will be involved in terms of money and documentation to commence legal action, the likely jurisdiction and venue, the timetable with respect to the legal activities. Only if, on consideration of this information you believe legal action is appropriate, will we instigate court proceedings.

At all times, our attorneys will consider the most appropriate location for the lawsuit, recognizing that we are interested in ensuring that any litigation will be the least expensive and annoying to you, and most calculated to elicit quicker results and cooperation in payment from the debtor.

After Placement of a Claim:

Once a matter is placed, it is strongly recommended that, if a debtor contacts you directly, you should refer the debtor to KMK and insist that the debtor deal exclusively with KMK until the matter is resolved. This allows us to maintain aggressive pressure and assures maximum results.
